How the new bankruptcy law will affect your ability to file?

The Changes:

     It is not my intent to cover every aspect of the new bankruptcy law since some areas of the law were changed but do not affect consumer debtors.  Rather it is my intent to provide information to those debtors who are considering seeking debt relief through either a Chapter 7 liquidation bankruptcy or a Chapter 13 debt consolidation or wage earner plan bankruptcy.

     Here is a list of the major changes that were made to the bankruptcy laws regarding consumer Chapters 7 and 13 bankruptcy. Click on each question to read how this will affect your ability to file.

1. All debtors seeking relief from the bankruptcy court will have to pass a means test in order to qualify to file a Chapter 7 bankruptcy case. 

2. If your household income exceeds the State of Georgia median income, you will not be able to file a Chapter 7 bankruptcy, unless you can get passed the means test.

 

Information designated by BAPCPA that will be needed for appointments.

A. Income

1. Paystubs for past six months.

2. Proof of other sources of income.

3. If you are self employed, proof of gross business income and expenses for past six months.

B. Home

1. Copy of deeds to property owned in last three years, including timeshares and condos.

2. Mortgage, home equity loan or line of credit statements.

3. Property tax bill

4. All recent utility statements.

5. Most recent Homeowners association dues statement.

6. Most recent Homeowners or renters insurance statement.

C. Vehicles

1. Vehicle registrations for all vehicles owned.

2. Proof of insurance

3. All recent vehicle statements.

D. Financial

1. Credit card statements for past three months and any collection letters.

2. Bank statements for each bank, credit union, investment or stock trading account.

3. Checkbook register for last 6 months.

4. Statement for any IRA, 401(K), education  individual retirement account, tuition credit program or medical savings account.

E. Domestic Matters

1. Child or family support orders.

2. Dissolution agreements or judgments.

3. Prenuptial or post nuptial agreements.

4. Registration certificate for domestic partners.

F. Identification

1. Driver’s license, Georgia ID or passport.

2. SS Card, a W-2; or an original tax notice showing your Social Security number.

G. Miscellaneous.

1. Contracts for purchase of vehicle, electronics, jewelry, etc. over time within past three years.

2. Lawsuits filed against you or by you in the past two years.
